In York, Pryers solicitors recently represented a claimant who was involved in a road traffic accident as a passenger. He was in a vehicle being driven by a friend who lost control of his car and collided with an oncoming vehicle. As a result of the accident the claimant suffered a whiplash type injury to his neck and lost the enjoyment of a pre-arranged holiday in America that started just two days after the accident.
Although liability for the accident was accepted, the insurers attempted to undervalue the claim offering the claimant just £1650.
We had valued the claim at £2800 and as the insurers would not improve upon the offer the claim went to trial.
The claimant was successful and the Court awarded him £2802.50 and his legal costs.

Compensation has been awarded to the family of a man who died after he was hit by a car.
Tony Gate, a highways worker, was struck by a vehicle being driven by 28-year-old Julie Verrall in 2003 as he put out roadworks signs, Hartlepool Today attests.
Although he survived the crash, he was left with serious brain damage and spent three years in a vegetative state in a nursing home before dying from pneumonia in 2006.
No criminal charges were brought against the driver, but Mr Gate’s family took legal action against her insurers.
They have now agreed to take some responsibility for the incident and have agreed on an undisclosed sum of compensation in an out of court settlement.
Linda Hughes, Mr Gate’s sister, said she was pleased with the new development.
"Tony was never able to tell us what happened on that day and now we feel the final piece of the puzzle has been found," she commented.
According to the Department for Transport, 2,943 people were killed on Britain’s roads in 2007.

A man whose life expectancy was reduced after he was seriously injured in a motorbike crash has been awarded compensation.
David McCullagh Junior, 30, was a passenger on a bike being driven by Anthony Leahy in June 2006.
However, the bike hit an earth bank and Mr Leahy lost control.
Mr McCullagh hit his head and is now confined to a wheelchair. He also has speech difficulties and his life expectancy has been reduced by around 29 per cent.
He sued Mr Leahy for negligence, claiming that he should have been able to control the vehicle.
This week, the court agreed upon a £4 million settlement in order to pay for Mr McCullagh’s long term care.
According to the Royal Society for the Prevention of Accidents, while the number of motorbike deaths fell in 2007, the number of people seriously injured on motorbikes rose last year. The organisation recommended better training for people riding such vehicles.

A man who was involved in a road accident eight years ago has been awarded compensation.
Police administrator Chris Chambers sustained fractures to his right leg, forearm and wrists, ligament damage to his knee and cuts and bruises to his neck, chest and face when he was struck by an uninsured driver in December 1999.
The motorist in question was travelling on the wrong side of the road when the collision occurred, the Star reports.
Mr Chambers, who required extensive medical treatment for his injuries, had now been awarded £90,000 by the Motor Insurance Bureau, which was established in 1946 to compensate the victims of uninsured and untraced drivers.
The 34-year-old stated: "My medical situation has continued to impact on my life due to the need for multiple operations and long-term rehabilitation."
Meanwhile, the other motorist was issued a fine after being convicted of driving without due care and attention.

A man who sustained serious injuries when he was struck by a motorist has received compensation of £1,123,676.
He was cycling to work when a disqualified motorbike rider who was being pursued by an unmarked police vehicle hit him.
As a result of the impact, he suffered damage to his right shoulder which has severely affected his ability to use his right arm. In addition, he had to have his right lower leg amputated.
The motorcyclist, meanwhile, died as a result of the injuries he sustained.
Because the biker was disqualified and therefore uninsured, the claim was pursued through the Motor Insurance Bureau.
Established in 1946, the bureau enters into agreements with the government to compensate the victims of negligent, uninsured and untraced drivers.
By virtue of the Road Traffic Act 1988, every insurer that underwrites compulsory motor insurance is legally obliged to contribute to its funding.
