Parents of cyclist killed by van launch legal action

The parents of a man who died when a van knocked him off his bike have launched legal action against the driver of the vehicle.

Anthony Maynard, 25, was killed near South Oxfordshire in July 2008 when the van being driven by Michael Large collided with his bicycle, Get Reading reports.

He died instantly and his parents David and Susan believe Mr Large was responsible for the accident because he was driving negligently.

"I am very disappointed [that] after 13 months neither the motorist nor his insurers have admitted liability. It is now therefore necessary to issue civil proceedings," Mr Maynard senior remarked.

If it can be proved that Mr Large made an error that led to the crash, the victim’s parents will receive a compensation payout for their loss.

Last month, an unnamed cyclist was awarded £5,000 in compensation after being knocked off his bike. He suffered minor injuries and post-traumatic stress following the incident.

Man takes legal action after contracting Legionnaires Disease

A man is taking legal action against a Florida hotel after he contracted potentially fatal Legionnaires’ Disease while on holiday.

Gary Ewans had taken his family to the Quality Suites Hotel in Orlando, but became one of four people to contract the bug.

He was only diagnosed upon his return to Sheffield’s Royal Hallamshire Hospital and was then off work for a month. Mr Ewans claims that he has still not returned to full health.

"This was supposed to be a fantastic family holiday in the Florida sun but instead I ended up in hospital with a potentially deadly disease," he commented.

It is claimed that the hotel was poorly managed and that the pool was rarely cleaned. Mr Ewans has launched a compensation claim against it in a bid to be remunerated for the suffering he was caused.

According to the Health and Safety Executive, Legionnaires’ Disease is a potentially fatal form of pneumonia that is caused by the bacterium Legionella pneumophila.

Man may launch legal action after alleged clinical negligence

A man who was wrongly told he had terminal cancer is considering launching legal action against the hospital responsible for the mistake.

Andy Lees, 72, went into hospital for tests and was told he had cancer of the lungs and liver.

He then spent £6,500 making funeral arrangements, as well as giving £12,000 of his savings to friends and family.

However, he was then told he did not have cancer, but was in fact suffering from chronic obstructive pulmonary disease.

Mr Lees said he has been left penniless by the misdiagnosis.

"We just presumed that the doctor would be right. Now I am broke. I am definitely considering suing the hospital," he commented.

An investigation has now been launched by NHS Lothian as to how the errors occurred.

Clinical negligence occurs when a professional in the health service provides care that is deemed to be below standard and this causes physical injury, death or distress.

Negligence may occur from delay or failure to diagnose a condition, delay or failure to treat a condition, when a treatment goes wrong, use of the wrong treatment, or failure to obtain consent.

Man to be allowed to take action over alleged medical negligence

A man has won the right to take legal action against a hospital he accuses of medical negligence.

Jonathon Khairule suffers from cerebral palsy, a physical condition that affects movement.

He is wheelchair-bound and communicates by typing on a keyboard with his nose, the Coventry Telegraph reports.

Recently, the 27-year-old secured the right to bring a birth injury claim against the North West Strategic Health Authority, despite the fact that he did not take legal action within the normal time limit set in such cases.

He stated: "It wasn’t until I was in my early 20s that I started to do some investigating. I did not know if I would be able to claim compensation, I just wanted answers."

In July, the high court ruled Mr Khairule’s claim could proceed and he is now free to take action against the health authority.
