In York, Pryers solicitors recently represented a claimant who was involved in a road traffic accident as a passenger. He was in a vehicle being driven by a friend who lost control of his car and collided with an oncoming vehicle. As a result of the accident the claimant suffered a whiplash type injury to his neck and lost the enjoyment of a pre-arranged holiday in America that started just two days after the accident.
Although liability for the accident was accepted, the insurers attempted to undervalue the claim offering the claimant just £1650.
We had valued the claim at £2800 and as the insurers would not improve upon the offer the claim went to trial.
The claimant was successful and the Court awarded him £2802.50 and his legal costs.

A man whose personality was altered forever after he was involved in a fatal road crash has been awarded compensation to cover his future care.
Marcus Dean Julian, then 19, was a passenger in a car being driven by Jonathan Stephens in 2003, the Plymouth Herald reports.
The driver lost control and the car left the road near Liskeard, rolling over several times. Mr Stephens was killed and Mr Julian suffered significant brain damage, as well as broken bones and internal injuries.
With the help of his family, the victim took legal action against Mr Stephens’ estate and his insurers have now agreed to an undisclosed payout.
Although the exact amount is not known, compensation for brain injury victims is usually more substantial than for other injuries and the sum is likely to be millions of pounds.
Anyone who is involved in a road traffic accident – including passengers in the car which caused the crash – may be able to claim compensation, however, it must be proven that another person or organisation was responsible for the injuries caused.

A woman who suffered "devastating" injuries in a car accident is to receive compensation of £1.5 million after a hearing in court.
Ruth Layton, now 25, was a passenger in a car being driven by Michelle Tocher near Truro five years ago.
The driver lost control of the car and it spun off the road. Ms Layton suffered broken bones and internal injuries, as well as head injuries that led to cognitive impairment of her memory and concentration.
Through her father, she sued Ms Tocher for damages and a judge has now agreed to a settlement of £1.5 million to cover any equipment, accommodation or care she may need in the future.
A common misconception when it comes to claiming compensation after an accident is that a person who was in the car that caused the accident cannot make a claim for injuries suffered.
This is untrue, as long as the person making the claim was not the one behind the wheel at the time of the accident.
It is perfectly legitimate to claim against the driver, as it is their responsibility to drive safely.

A man who was unknowingly exposed to Hand Arm Vibration Syndrome (Havs) has secured compensation from the council he worked for.
Joseph Beale developed the condition – which leads to leads to painful and disabling disorders of the blood vessels, nerves, joints and muscles of the hands and arms – in 2004 from using power tools like mowers for ten years.
He maintains that he was not warned about the dangers of the continual use of such tools and that Bridgend county borough council had not sufficiently protected its workers under the Control of Vibration at Work Regulations 2005.
"Despite having worked with vibrating tools for over ten years, the council did not warn me about the possible dangers and now I have developed a disease that I did not even know existed," Mr Beale remarked.
He has now been paid £3,000 in compensation as a result of the damage to his hands.
According to the Health and Safety Executive, around five million workers in the UK are exposed to Hand Arm Vibration at work.

Companies throughout the UK have been warned to control the risks of falls in the workplace after a firm was fined due to a worker suffering severe injuries from a fall.
In 2007, the employee at Spray-Craft Coating in Wellingborough fell more than two meters off a platform and suffered serious injuries, including fracturing a wrist and shoulder. He suffered bleeding to the brain and was in an induced coma for two weeks.
As a result, the company was fined £5,000 and ordered to pay £1,000 costs after pleading guilty to breaching Work at Height Regulations 2005.
Health and Safety Executive inspector Peter Snelgrove said that lax management is "unacceptable".
He added: "All companies must assess the risks from work that they are undertaking at height, ensuring that the work is planned properly and appropriate measures are taken so that workers are not exposed to risk of falling.
Recently, a firm from Rhonnda was fined £25,000 after a worker died from a five-metre fall.
