Injured paperboy in line for compensation

A paperboy who suffered a brain injury after being hit by a lorry has been told he is entitled to compensation.

Joshua Smith had applied for the position at the Co-op in Staffordshire just after his 13th birthday in 2005, the Staffordshire Sentinel reports.

However, days after beginning the job, he was hit by a vehicle being driven by Mark Hammond.

The victim suffered a fractured pelvis, an open head wound, a ruptured kidney, bruised lungs, cuts and bruises and a brain injury.

He now has short-term memory problems and is likely to need care later in life.

This week, a judge deemed that Mr Hammond was partly responsible for the accident as his brakes were faulty.

The amount of compensation Joshua will be entitled to is to be decided at a later date.

According to the Department for Transport, there were 28,572 people killed or seriously injured on Britain’s roads in 2008.

Former male model sues for being run over

A man who used to be employed as a male model is suing a man who he claims ran him over deliberately.

John Wotherspoon, 24, had been to Lava and Ignite nightclub in West Tollcross with a friend in June last year, but had an altercation with Alexander Bogdanovic as they left.

Although Mr Bogdanovic was evicted by bouncers, Mr Wotherspoon claims the man waited for him outside in a car and ran him down as he walked along Ponton Street.

He suffered a broken nose and cheekbone, concussion and cuts and bruises to his eye and bottom.

Mr Wotherspoon alleges that he has been left paranoid after the incident. He was also forced to give up his job as a naked butler due to his scarring.

He is now seeking compensation from Mr Bogdanovic in order to cover his injuries and his lost earnings.

Anyone who is involved in such an accident should seek the advice of a solicitor, as they may be able to claim compensation from the driver’s insurers.

Cyclist secures compensation after being injured in fall

A man who was riding his bike along a cycle path and fell off because of a dangerous drain is to be paid compensation for the injuries he sustained.

Iain Anderson, 42, was cycling through Holyrood Park in August 2005 when his bike hit a sunken drain at the end of a gully.

He was thrown off the bike and smashed his cheekbone, sprained his wrists and suffered cuts and bruises.

Witnesses attested that Mr Anderson had not been riding erratically and that the accident was due to the uneven cycle path.

He took legal action against Scottish ministers – because the path is owned by Historic Scotland – and has now been awarded £5,750.

A spokesperson for Historic Scotland said: "This was an unfortunate incident and we hope Mr Anderson is recovering well."

In April, it was reported that cyclist Ian Davis was to receive £7,600 in compensation after breaking his ribs and dislocating his shoulder when he was thrown over his handlebars because of a pothole in West Berkshire.

HSE warning after workplace accident

The Health and Safety Executive (HSE) has issued a warning to all employers that they must provide a safe place to work in order to avoid injury and potential prosecution.

Its advice comes after Sunderland-based car parts manufacturer International Automotive Components Group was fined under health and safety regulations when a man sustained serious injuries on its premises.

Trevor Rollin had been using an overhead crane to unload tools from a metal rack in August 2008 when it collapsed and fell onto him.

The employee suffered multiple fractures, as well as cuts and bruises.

International Automotive Components Group was found not to have provided stabilisation for the single bay tool racking and was fined under Regulation 20 of the Provision and Use of Work Equipment Regulations 1998.

HSE Inspector Fiona MacNeill said: "The safety of work equipment cannot be taken for granted. Employers should assess and prioritise the more serious risks in their premises."

According to additional figures from the HSE, six million working days were lost to injury between 2007 and 2008.

Pensioner in footpath fall seeks compensation

A woman who has been left in fear of leaving the house after a fall on an uneven pavement is seeking compensation from her local council.

Daphne Slater, 73, was being pushed in a wheelchair to the doctors’ surgery by her son Stephen when he and the chair tripped over a sharp rise in the footpath, the Eastwood Advertiser reports.

Ms Slater fell from the chair and suffered cuts and bruises to her face, hands and feet, the Eastwood Advertiser reports.

She is claiming compensation from Nottinghamshire county council, alleging that it had not kept the path in a satisfactory state of repair and that it resurfaced it shortly after her accident.

The council has denied liability and declined to comment on the case while it goes through the appropriate legal channels.

Local council highways departments are usually responsible for maintaining and monitoring the condition of pavements, roads and highways.

They will be considered liable for any injury sustained in a pavement tripping accident if they have failed to have an adequate inspection regime or if they have not repaired any section of pavement that was known to be defective.
