Woman injured by scooter to launch legal action

A woman who was knocked down by a mobility scooter is considering launching legal action against the driver.

Margaret Scott, 53, was walking in the town centre of Melksham when she was hit by the vehicle, thisiswiltshire.co.uk reports.

She was knocked to the ground and suffered a fractured collarbone, as well as cuts and bruises.

The man who hit Ms Scott left the scene and consequently, police have been unable to prosecute him because of the Data Protection Act.

Ms Scott said she is considering seeking the advice of a solicitor in order to make a personal injury claim.

"I’m just worried that if this was to happen to an elderly person or a child then the outcome could have been even worse," she commented.

People who feel that they may be entitled to damages should seek legal representation as soon as possible as there is a time limit of three years on personal injury claims.

Woman injured in pothole fall to seek compensation

A woman who was hurt after falling into a pothole while out cycling is to seek compensation from the council she holds responsible.

Penny Edwards, who has previously competed in cycling competitions, was riding her bike into Norwich city centre when the front wheel got caught in an uneven part of the road, the Norwich Evening News reports.

She fell off the bike and suffered cuts and bruises to her face, as well as a chipped tooth.

"It was awful. It didn’t look like much but it really was nasty," Ms Edwards remarked.

She added that she plans to take legal action against Norfolk county council for failing to adequately maintain the road.

A spokesperson for the council said it uses a "common sense approach" when deciding whether or not to fix potholes.

According to the BBC’s Inside Out programme, 20 councils paid out £1 million in damages between 2005 and 2007 as a result of injuries and damage allegedly caused by potholes.

Bridge accident sees rambler awarded damages

A woman who was injured in a bridge collapse while she was out rambling has secured a compensation payout.

Birgit Green, 63, was walking within a nature reserve in 2005 when the sides of the bridge she was on collapsed.

She fell and claims to have suffered broken bones in her feet, as well as cuts and bruises, the Telegraph reports.

Ms Green also alleges that she was forced to use a wheelchair as a result of having a plaster cast on her foot.

She claimed East Sussex county council was negligent and that the bridge was "fundamentally unsafe".

The council countered that Ms Green should have taken more care and that "she failed to look where she was going, failed to notice the hole when it should have been obvious to her."

However, the judge ruled in favour of the claimant and Ms Green has been paid £3,000 in compensation.

According to the Ramblers’ Association, authorities have a duty to maintain all public rights of way to a sufficient standard.

Cyclist secures compensation for hedge debris crash

A disabled cyclist has been awarded compensation after he was injured in an accident caused by hedge debris.

Andy Ebben, 55, was riding his specially-adapted bike down a country lane when both of his tyres were punctures by hawthorn and blackthorn that had been clipped and not cleared up.

He was thrown from his bike – which was seriously damaged – and suffered cuts and bruises. He also had to call for help from the side of the road when he could not get up.

Mr Ebben has now been paid an undisclosed sum of compensation from the landowner and said that more consideration should be given to road users.

"If there had been warning signs, I would have taken an alternative route that day. There is a clear responsibility to warn road users of potential hazards and to clear the road as soon as possible," he commented.

Cyclists injured in road accidents may be able to claim compensation for pain and suffering, treatment costs and cycle repair if it can be proved that the accident happened as a result of negligence.

Road accident victim secures damages

A man who was involved in a road accident eight years ago has been awarded compensation.

Police administrator Chris Chambers sustained fractures to his right leg, forearm and wrists, ligament damage to his knee and cuts and bruises to his neck, chest and face when he was struck by an uninsured driver in December 1999.

The motorist in question was travelling on the wrong side of the road when the collision occurred, the Star reports.

Mr Chambers, who required extensive medical treatment for his injuries, had now been awarded £90,000 by the Motor Insurance Bureau, which was established in 1946 to compensate the victims of uninsured and untraced drivers.

The 34-year-old stated: "My medical situation has continued to impact on my life due to the need for multiple operations and long-term rehabilitation."

Meanwhile, the other motorist was issued a fine after being convicted of driving without due care and attention.
