A firefighter who was seriously injured in a house fire is claiming compensation of up to £500,000 from his employers.

Ian Tape, 34, was attending a blaze in Sheffield in 2007 when a door upstairs exploded and he and a colleague became trapped.

He tried to send a distress message, but claims that the radio was faulty. In order to escape, he and his fellow worker had to smash a downstairs window and climb out unaided.

Mr Tape also alleges that advice from South Yorkshire Fire and Rescue telling the workers to spray the building with water intensified the fire.

He is claiming up to £500,000 in compensation after suffering serious burns in a high court writ that states the employees were not protected due to faulty equipment and poor training.

A spokesperson for the fire brigade said: "This was an extremely tragic and distressing event for all those involved, and we have agreed to pay Ian damages to compensate him for the injuries he sustained."

He added that the amount Mr Tape will receive is still under discussion.

Workers have a legal right to seek for compensation should they be injured while carrying out the objectives of a company or organisation – including the emergency services – and should seek the advice of a solicitor.

Firefighter attacked by youths receives CICA payout

A firefighter who was attacked by a gang of youths as he attempted to put out a house fire has received a compensation payout for the injury he received.

Peter Woodhead, 41, was one of five men who attended the blaze in Stockton last May.

However, as the team tackled the fire, their equipment was stolen by a nearby gang. When the firefighters tried to retrieve it, they were surrounded and set upon by the gang, some of whom had wooden fence posts.

Mr Woodhead suffered a broken elbow. He contacted the Fire Brigades’ Union (FBU) in order to seek compensation through the Criminal Injuries Compensation Association (CICA).

In a new development, he has now secured an undisclosed sum from the organisation.

Anyone pursuing a similar claim through the CICA should be aware that there is a two year deadline for making it, instead of the usual three year deadline for standard personal injury compensation claims.

Misdiagnosed man to sue NHS

A man who was wrongly diagnosed with cancer is to sue the NHS after he had a healthy lung removed unnecessarily.

Laurence Ball, 58, was admitted to hospital in 2005 after suffering from a chest infection.

However, doctors told him that he had lung cancer and that he would have to have an operation in order to remove the tumour.

He did so three months later, however, when he woke up, he was told that there never was a tumour.

Mr Ball, a former firefighter, said: "I was given a misdiagnosis, I’ve lost my lung and I lost my job. For those reasons I feel that at the very least an explanation should be given to me by the health board that should sit down and discuss financial compensation for my loss of earnings."

An NHS spokesperson said the organisation cannot comment for legal reasons.

Wrong diagnosis occurs when a healthcare professional fails to give an accurate diagnosis, specifically by diagnosing a patient with the wrong disease, an absent disease, or as healthy when there actually is a disease.

Victims of wrong diagnosis and other types of malpractice may have a legal right to recover their damages, including medical expenses, pain and suffering, lost wages and earning capacity.ADNFCR-1694-ID-18730297-ADNFCR
