Pryers solicitors in York recently won a settlement of £100,000 for a clinical negligence claim. A man suffered complications following a hip resurfacing operation that was carried out negligently. The hip dislocated, requiring a total hip replacement. Unfortunately, the replacement was also carried out negligently, leaving him with a leg length discrepancy that caused him to develop a fixed deformity of the knee. Following further problems with pain and dislocation, he subsequently required a further revision operation, carried out by a different surgeon. This has left him with improved pain and function.
Cleaner receives £80k compensation after bakery fall
March 10th, 2009
A man who fell 14 feet off a ladder has secured compensation after he was forced to retire.
Jeffery Phillips, 59, had worked at Gunstones Bakery in Dronfield for 11 years when he was asked to clean the top of a divider machine in preparation for a customer visit in 2006, the Sheffield Telegraph reports.
However, the ladder he was using to reach the top of the machine slipped and Mr Phillips fell to the floor, breaking his hip, fracturing his elbow and hurting his hand.
He needed a hip replacement and was forced to give up work.
Mr Phillips took legal action against Gunstones Bakery, which admitted liability and agreed to an out-of-court settlement of £80,000.
"I decided to pursue compensation because I wanted the company to take full responsibility for the accident," the victim said.
He added that he had never received training in the use of ladders and would not want a similar fate to happen to anyone else for the same reason.
According to the Health and Safety Executive, ladders accounted for the greatest number of major injuries to employees due to both high falls (40 per cent) and low falls (28 per cent) in 2007-08.
Woman receives compensation after workplace fall
August 15th, 2008
A former healthcare assistant has received an unspecified sum of compensation after slipping at work.
The unnamed woman was at work in a hospital when she responded to a call from a patient.
However, on her way to answer the call, the woman slipped on some anti-bacterial hand gel that had been spilt.
She fell and fractured her hip, Legal and Medical News reports.
Although she underwent immediate surgery, this was unsuccessful and the woman had to have a hip replacement. She was also forced to retire from her job.
She commented: "If simple measures had been taken to ensure that the floor was safe for me and others to walk on, I would not have been put in this position."
Slips and trips account for many workplace accidents, but there is legislation in place to protect employees from such incidents.
Anyone injured at work should contact a legal representative as soon as possible, as time limits exist upon claims.
