Here at Pryers solicitors in York we are pleased to detail another successful case. Our client had an anal fistula which was treated with insertion of a seton. There was then an unacceptable and substandard delay in further management and treatment, causing 18 months of PSLA (Pain, Suffering & Loss of Amenities). She finally received appropriate treatment which resolved the problem.
A medical negligence complaint was pursued to which we received an indifferent response. After obtaining the medical records and reviewing them, it seemed that the case looked very strong and causation was limited. The claim was valued at £5,000 – £10,000. A Letter of Claim was sent together with a Part 36 Offer for £15,000. We got a Letter of Response admitting liability with a counter offer for £10,000, which the client accepted today.

A man who sustained a serious injury at work is to receive £25,000 in compensation from his former employer.
The 32-year-old victim, who cannot be named, was working in a steel factory in Yorkshire when the accident happened.
He had been helping a crane operator to move pieces of steel when the load suddenly shifted and fell.
The heavy steel landed on the man’s foot, crushing it badly. He had to take seven months off work and now has limited movement in his ankle and foot, meaning that he can no longer play football or run.
He took legal action against his employer, who admitted liability and agreed to a compensation payout.
Employers have a duty of care towards their workers which means they must reduce the likelihood of injury by eliminating hazards where possible. If this does not occur, people who are injured may be eligible to claim compensation, as was the case here.

Soldiers injured during their time in service are to see the compensation they are paid double after the introduction of new measures by the government.
Previously, payments were made at 100 per cent for the first injury, 30 per cent for the second and 15 per cent for the third, but claims could not be made for any further physical damage suffered.
Claims were also limited to £285,000.
However, the maximum compensation will now increase to £570,000, on top of the monthly, tax-free, index-linked payments that the soldier will receive for the rest of his or her life.
Commenting on the new initiative, defence minister Kevan Jones said: "Our armed forces are inspirational and they deserve the very best support. This increase in our compensation package will be a great boost to our injured personnel and their families."
The payments should begin to come through in the next few days and a spokesperson for the Royal British Legion said the organisation is very pleased with the new development.
