Recently we concluded a medical negligence case against an NHS Trust in which a patient had an operation in which his full stomach was removed (gastrectomy). He had been told that he was suffering from cancer when in fact after biopsies were carried out it was revealed that he was not suffering from cancer, he was suffering from a peptic ulcer. The Trust fought the case, literally up to the door of the court before conceding negligence and agreeing the settlement which included damages for the stomach removal and the lifetime effects of that as well as damages for lost earnings and other expenses.

Girl wins medical negligence claim for brain damage

A 14-year-old girl has been awarded millions in compensation after winning a medical negligence claim against the Norfolk and Norwich Hospital.

Tahlia Downes was deprived of oxygen during her birth, leaving her with severe mental and physical disabilities.

Her mother brought the medical negligence claim against the hospital on the grounds that she should have been given a Caesarean section during the birth, reports the BBC.

Norfolk and Norwich Hospital will pay the family compensation after the judge in the case ruled that it should pay 70 per cent of the full valuation of the claim.

The payout is expected to run into millions once a final figure is reached, money that will be used to provide care for Tahlia for the rest of her life.

Last month, ten-year-old Harry Snowdon of Oxfordshire was awarded £7.1 million in compensation in a similar medical negligence case against Oxford Radcliffe Hospitals NHS Trust, in which he was left with brain damage following difficulties with his birth.

Essex hospital admits medical negligence

A woman from Essex is to receive compensation after a hospital failed to deal with a condition which led to her baby being stillborn.

Princess Alexandra Hospital NHS Trust in Harlow is to pay Louisa Greenslade a five-figure sum after admitting medical negligence, reports the Harrow Herald.

The admission came after routine tests carried out in March 2005 during Ms Greenslade’s pregnancy detected unusual levels of glucose and protein.

Although the results may have been indicative of gestational diabetes, staff at the hospital did not act on them.

Ms Greenslade’s daughter Rowen was stillborn in June 2005.

In 2006, she gave birth to a healthy son, Flynn. During that pregnancy she received treatment for gestational diabetes at Addenbrooke’s Hospital in Cambridge.

A spokesman from Princess Alexandra Hospital NHS Trust said it had now put in place measures to minimise the risk of a similar medical negligence case occurring in its maternity unit.

News of the settlement came as the Safer Births network was launched to help improve safety standards in England’s maternity departments.ADNFCR-1694-ID-19357502-ADNFCR

Pensioner to receive apology in alleged medical negligence case

A man who claims his wife died as a result of medical negligence is to receive an apology from the hospital involved.

Phyllis Harvey lost her life two months after having bowel surgery at King’s Mill Hospital, which is located in Sutton in Ashfield in Nottinghamshire and is run by the Sherwood Forest NHS Foundation Trust.

Despite the initial procedure being a success, the 73-year-old became increasingly frail in the following weeks, suffering from a lack of nutrients and from bed sores, the Mansfield Chad reports.

According to her husband, Peter Harvey, she died as a result of "medical negligence and lack in the duty of care".

In a recent development, the foundation trust has confirmed it is to apologise to Mr Harvey.

Its chief executive Jeffrey Worrall said: "We are very sorry for the standard of care that was given to Mrs Harvey and we will be apologising in writing to Mr Harvey for what happened."
