£70k payout for family of Isle of Wight crash victim

The family of a man who was run over and killed on the Isle of Wight is to receive a compensation payout of £70,000.

Thomas Whittaker was hit by the vehicle in the early hours of August 14th 2004 and died at the scene, the Isle of Wight County Press reports.

It was found that the victim had already been lying in the road near Carisbrooke at the time of the accident, although it is not clear if he was ill or had fallen and could not avoid the car.

Mr Whittaker’s family took legal action against the driver of the vehicle and the unnamed motorist’s insurers have now agreed to the compensation payout.

"This was a tragic accident on the Isle of Wight in which four children lost their father," said the family’s spokesperson.

Anyone who is affected by a road accident should not worry about their compensation coming from the driver of the vehicle, since it will always be paid out by their insurers, or the Motor Insurers’ Bureau if the responsible party does not hold a valid policy.

A cyclist who was knocked off his bike on a narrow road bridge has been awarded £5,000 in compensation.

The unnamed 58-year-old claimed that he had waited for the car to pass him, but it clipped him anyway and knocked him off, causing injuries to his ribcage, foot, thigh and arm.

He said that although he was a keen cyclist before the accident, he became fearful of getting back on the bike and was afraid to do so for eight months.

The victim took legal action against the driver and although he did not admit liability, he has now agreed to a payout of £5,000 for the cyclist as part of an out-of-court settlement.

Last month, a man who was left tetraplegic in a cycling accident in 2005 was awarded a substantial sum in compensation from the Motor Insurers’ Bureau.

Graham Gregory suffered serious spinal injuries when the driver, who was not insured, hit him.

1 in five young motorists driving without insurance

A new report has discovered that as many as one in five young people is driving without the correct level of insurance.

The Motor Insurers Bureau (MIB) found that 250,000 people aged between 17 and 20 are taking to the roads without cover, putting insured drivers at risk if they are hit.

Many young people claimed they did not know that insurance is a legal requirement, while others said that the high cost of insurance has led to them breaking the law.

Ashton West, chief executive of the MIB, commented: "While we recognise the financial pressures for drivers taking to the roads for the first time, it is also a criminal offence to drive without proper insurance cover."

The MIB was established to deal with cases stemming from uninsured driver accidents and manages over 30,000 claims from people who have been hit by someone without cover every year.

Anyone involved in such an accident may wish to seek legal advice, as motoring claims can be complicated and lengthy.

A man who suffered long-lasting injuries after he was hit head-on by another vehicle is to receive £3.3 million in compensation.

Sean Milligan, 44, had been driving in Lanarkshire in May 2004 when Mark Lynch came in the other direction on the wrong side of the road.

Mr Milligan sustained injuries to his brain which mean that he is now unable to care for himself and suffers from bouts of anger. He also has difficulty balancing and walking, the BBC attests.

He took legal action against Mr Lynch and the Motor Insurers’ Bureau (MIB) has now agreed to the payout.

Making the ruling, Lord Woolman at the Court of Session in Edinburgh said Mr Milligan’s compensation should be particularly high due to his pain and suffering.

The MIB aims to reduce the level and impact of uninsured driving and handles 30,000 claims every year for accidents which involve uninsured vehicles.

Injured cyclist receives multi-million pound settlement

A man who was left tetraplegic in a cycling accident four years ago is to receive compensation from the Motor Insurers’ Bureau (MIB).

Graham Gregory, 48, had been riding his bicycle in West Swindon in 2005 when he was hit from behind by a car.

He was thrown from the bike and sustained serious spinal injuries. Despite spending weeks in intensive care, Mr Gregory was paralysed and is now unable to care for himself.

The victim sued the driver who hit him, but it was discovered that he was not in possession of the correct insurance and the MIB took over the case.

In a new development, it has now admitted 90 per cent liability for the crash and is to pay Mr Gregory compensation that could amount to £4 million in order to cover his long-term care.

According to the MIB, three people every hour are injured by uninsured or hit and run drivers in the UK.
