Clinical negligence client wins inflammatory bowel case

Surgery can lead to clinical negligence claimsAt Pryers, the North Yorkshire based solicitors, a settlement in the sum of £65,000 was recently handed to a clinical negligence client. The client had an inflammatory bowel condition and was advised to have a bowel resection which involved removal of part of the colon and creation of a colostomy. The operation caused damage to his spleen and he needed a splenectomy (removal of the spleen). Independent medical evidence established that the client did not in fact need to have the operation in the first place as there were surgical alternatives. The defendant settled the case on a global basis, mainly for the pain and suffering.

Compensation secured for whiplash victim

A man who suffered whiplash after being involved in a car crash has secured compensation.

The unnamed man was travelling in Malton, North Yorkshire, when his vehicle was hit from behind by another car.

It was shunted forward suddenly, causing the victim to suffer a neck and back injury. He went on to develop headaches and pins and needles down his arm.

The car was also damaged, requiring him to hire a replacement vehicle for several weeks.

Advice was sought regarding a personal injury claim and the driver of the other vehicle went on to admit liability.

The victim is to be awarded £15,500 for injuries, damage to his vehicle and lost earnings.

According to Patient.co.uk, two in three people involved in a car crash develop neck pain.

Anyone who has suffered from whiplash following such an accident and who can prove that it was not their fault may be eligible for compensation and should seek the advice of a solicitor.

Farm worker awarded compensation for horrific injury

A farm worker has been awarded compensation for an accident which occurred while he was working on a farm.

Pawel Piasecki, a Polish student, was cutting wood on the property in North Yorkshire, owned by Adrian and Bridget Thornton-Berry.

The tractor-driven circular saw he was using jammed and he attempted to lubricate it while it was still moving, the Northern Echo reports.

As a result, the middle finger of his left hand was severed and his ring finger was reduced to a stump.

The Health and Safety Executive (HSE) prosecuted the couple for breaching safety regulations and they were fined £3,000, as well as £1,000 in costs.

Mr Piasecki was also awarded the undisclosed sum in compensation.

HSE spokesperson Charlie Callis said: "The young man was shown how to use this machine and then very much left to get on with it. If he had been properly supervised, this horrific accident would not have resulted."

Farm workers, like construction workers, are at high risk of injury or death due to the fact that they are constantly operating heavy farm machinery.

If a compensation claim is made, it is the company’s insurers who would pay, including for loss of earnings as a result of the accident.
