Here at Pryers solicitors in York we have just represented a claimant who was a prison officer. He suffered personal injury during the course of his employment. Whilst accompanying one of his colleagues who was driving a vehicle within the prison grounds, the claimant had to open a security gate and whilst he was standing by the gate, his colleague, attempting to drive through the entrance, trapped the claimant between the vehicle and the gate causing a significant shoulder injury.
Liability for the accident was disputed by the employer’s representatives who maintained that the claimant was the author of his own misfortune.
We successfully argued breaches of Health and Safety regulations and the claimant received compensation of almost £14,000.

Pryers, the York based solicitors have recently represented a claimant who suffered an accident whilst visiting a local gymnasium. Whilst using a wall mounted seat in the disabled shower area, the seat failed and the claimant suffered an injury to her knee and lower back.
Liability was initially disputed and the defendant refuted the claimant’s medical evidence making derisory offers in settlement of a claim.
At trial, the claimant’s evidence was proved and she recovered £4500 by way of compensation.

epresented a claimant who was employed in a children’s nursery. She suffered an accident whilst required to use a ladder in order to gain access to reset a defective electrical consumer unit. The ladder slipped and the claimant fell some distance suffering multiple minor injuries.
Liability and the value of the personal injury claim were both disputed by the employer’s insurers who maintained that the claimant was the author of her own misfortune.
We successfully argued breaches of Health and Safety regulations and the claimant received compensation of £5,400.

A man whose arm was ripped off as he worked at a waste treatment plant is seeking £2 million in compensation for his pain and suffering.
Steven Gallon, 42, was an employee at Inverboyndie Waste Treatment Plant in Banff in 2004 when he attempted to clear a blockage on a piece of machinery.
His arm was caught between an unguarded roller and a conveyor belt and was pulled out due to the force, along with his shoulder and part of his collarbone.
At the time, the company was prosecuted by the Health and Safety Executive (HSE) for failing to train its employees and not putting a guard in place on the roller.
Mr Gallon also sought legal action to pursue a personal injury claim against Aberdeenshire Council.
A spokesperson for the council declined to comment while the case goes through the appropriate legal channels.
HSE statistics show that the recycling sector had five times more injuries in 2007-08 than manufacturing as a whole.

A man who suffered whiplash after being involved in a car crash has secured compensation.
The unnamed man was travelling in Malton, North Yorkshire, when his vehicle was hit from behind by another car.
It was shunted forward suddenly, causing the victim to suffer a neck and back injury. He went on to develop headaches and pins and needles down his arm.
The car was also damaged, requiring him to hire a replacement vehicle for several weeks.
Advice was sought regarding a personal injury claim and the driver of the other vehicle went on to admit liability.
The victim is to be awarded £15,500 for injuries, damage to his vehicle and lost earnings.
According to Patient.co.uk, two in three people involved in a car crash develop neck pain.
Anyone who has suffered from whiplash following such an accident and who can prove that it was not their fault may be eligible for compensation and should seek the advice of a solicitor.
