Pensioner awarded £17k after hotel fall

A woman who was injured after being knocked over by a dog in a hotel car park has been awarded damages of £17,000.

Violet Mullock, 69, had been waiting for a lift home after attending a function at the Elms Hotel and restaurant near Chester in 2003.

However, as she stood in the dark, the barman’s dog ran towards her and knocked her off her feet.

Ms Mullock had to have surgery on her knee and also badly hurt her elbow. She took legal action against the hotel’s owner Thomas Price and has been awarded compensation of £17,500 following a recent hearing.

Mr Price has now applied to the Financial Services Authority in order to cover the payout after being let down by his insurance company.

Scottish schools pay £2m compensation since 2004

Teachers’ unions have said that schools need to become safer after it was revealed that over £2 million has been paid out in compensation by Scottish schools since 2004.

According to figures released this month, £1.5 million was paid out to injured staff, while another £600,000 was given in compensation to pupils, STV reports.

One claim was from a school worker who tripped over a carpet in West Dunbartonshire and was paid £4,000.

Another came from a pupil who fell on the school steps in Glasgow and was awarded £29,000 in compensation.

Sources from teachers’ unions said it is not satisfactory that staff are having to claim for accidents that could easily be avoided if education facilities were safer.

Occupiers of schools have the same responsibility to prevent injury as any other landowner so anyone who suffers from an accident on school premises should seek the advice of a solicitor specialising in personal injury claims.

Boy claims damages after trampoline fall

A child who badly hurt his arm in an accident at a gym club is claiming damages from the organisation he and his family hold responsible.

Sam Holland, 13, was taking part in an open play session at the Pipers Vale Gymnastics Club in September when a member of staff jumped on the trampoline that he was using, local paper the Evening Star attests.

He fell off the trampoline and landed awkwardly on his arm, dislocating his elbow. It had to be put into a sling and he was unable to play sport for three months.

Sam’s family has begun legal proceedings against Gymnastics, which is responsible for the athletics group, in the hope of claiming compensation for his injury.

The child has been asked not to return to the club while legal proceedings are underway, which the family has described as "a slap in the face".

Anyone who suffers a sports injury should be able to claim compensation if someone else is to blame for the incident and should seek the advice of a solicitor specialising in personal injury claims.

Road accident victims should always seek legal advice

A law expert has warned people in the UK that they may not get the compensation they deserve after a road accident if they simply pursue their claim through an insurance company instead of seeking legal advice.

At a recent event hosted by the Association of Personal Injury Lawyers, the organisation’s president Amanda Stevens said that while a solicitor will work with the victim to make sure a fair outcome is reached, insurance companies will mostly want to get the claim processed quickly, the Liverpool Post reports.

She brought up the example of a woman who was offered £1,000 by her insurance company after a car crash, but realised after consulting her solicitor that she could receive a sum 1,000 per cent higher than this.

Simon Shaw, a solicitor in Liverpool, added: "The only way to ensure you will achieve full recognition and just compensation for the injuries you have sustained is to take independent legal advice from a recognised solicitor."

All personal injury claims must be lodged within three years of an accident or the victim will lose their right to bring about a claim.

Paramedic wins fight for more compensation

A paramedic who took a petition to Downing Street in order to claim what he believed to be a fair sum of compensation after a devastating injury has won his fight for justice.

Nick Horobin was a paramedic driving a patient to hospital in Uttoxeter in 2001 when someone on a bridge threw a concrete block onto the windscreen of the vehicle.

He was hit by the block and lost an eye. Mr Horobin also suffered brain damage and had to teach himself to walk again.

The victim received £40,000 in compensation originally, but after an eight-year battle, he has now secured £100,000.

"It feels wonderful and it means I can concentrate on the future because this was the final thing that needed sorting," Mr Horobin remarked.

Compensation for brain injuries is normally a larger sum than that awarded for other personal injuries, since long-term care must be taken into account.

Anyone who has suffered in a similar fashion to Mr Horobin should seek the advice of a solicitor specialising in personal injury claims.
