A judge has ordered a shop assistant to pay personal injury compensation out of his wages to a man he attacked at a railway station.

Joshua Preece, 19, admitted charges of actual bodily harm over the incident in which he punched and stamped on Matthew Hale in an argument over a girl, reports the South Wales Echo.

At Cardiff Crown Court, Judge Stephen Hopkins took account of Preece’s previous good character to allow him to escape being sent to a young offenders’ institution.

Instead he was ordered to pay personal injury compensation of £250 at a rate of £10 per week.

Preece, of Bridgend, will also have to carry out 120 hours of community service as part of his punishment.

The incident occurred in February this year at Pencoed Railway Station.

Earlier this year, John Guest of Poole was awarded £1,000 in personal injury compensation after he was attacked by Christopher Watts in his own home.

A man who worked for Morrisons is suing the supermarket chain after suffering horrific injuries in the car park of one of its stores.

Kevin Brookshaw was arriving for a night shift at the Morrisons store in Crewe in December 2006 when the accident occurred, the Crewe Chronicle reports.

As he drove under the car park’s barrier, it suddenly swung forward and crashed through the windscreen of his car.

Mr Brookshaw’s facial injuries were so severe that his wife Pauline did not know him at first. He will never be able to eat or speak properly again and has to be fed through a tube.

"Kevin was literally unrecognisable. His face was entirely split down the middle and covered in blood," Mrs Brookshaw said.

At a recent hearing, Morrisons was fined for breaching health and safety regulations and has admitted liability for Mr Brookshaw’s injuries. It is thought that he will receive a substantial sum in compensation for his pain and suffering.

The supermarket chain said it has since changed the design of the gates on all its stores.

A woman from Salisbury is to make a compensation claim after tripping on an uneven pavement and breaking a bone in her foot.

Janet Street, 62, told the Salisbury Journal the incident happened because of a drop of one inch in the level of the pavement in Albany Road.

She claimed that the pavement in the area is in a "very bad way".

"My foot is in plaster and I will not be able to work for the next four to six weeks," Mrs Street added.

The sheltered housing worker is now planning to make a compensation claim and has taken photographs of the pavement where the incident occurred to use as evidence.

A recent series of Freedom of Information requests by the Liberal Democrats revealed the extent of the problem of poorly-maintained pavements in England.

The requests revealed that local authorities paid out £82 million to settle compensation claims related to injuries caused by uneven pavements between 2004 and 2009.

New figures released under the Freedom of Information Act have revealed that Leeds City Council has paid out over £10 million in compensation to people who have been injured on faulty footpaths over the last five years.

Some 2,904 such claims were put in between 2004-05 and 2008-08 as a result of damaged or badly maintained footpaths, the Yorkshire Evening Post reports.

This was the highest number of any council in the UK and resulted in total payouts of £10,259,125.

The Liberal Democrats ordered the survey and spokesperson Norman Baker said he feels the council is simply paying claims instead of making appropriate repairs to the paths.

He added: "Too many councils seem interested only in motorists and not those who walk, cycle or take the bus."

Councils and highways agencies are responsible for the maintenance of footpaths and roads and must carry out regular checks.

A professional dancer who fell because the paving slabs on a footpath had become sunken is claiming compensation for her injuries.

Jennie Freedland, 31, stumbled and lost her balance on Chester Street on June 22nd because of the height of the slabs, sustaining sprains to her hand, knee and foot, the Chester Evening Leader reports.

She blames Cheshire West and Chester council for the "faulty design" and said it was a hazard to pedestrians. She also said that she has been unable to work in her beauty therapist business since the accident.

"Basic tasks have become really difficult. I have not even been able to drive," Ms Freedland added.

A spokesperson for the council said it cannot comment until an investigation into the matter is complete.

The Ministry of Defence (MoD) is facing paying more than £5 million in compensation to soldiers affected by a debilitating foot condition.

It has received some 150 claims from personnel affected by Non Freezing Cold Injury, a condition similar to the trench foot that threatened soldiers during World War I.

Legal representatives say that the servicemen were inadequately protected from the cold due to a lack of personal protective equipment.

One unnamed man, speaking to BBC Radio 4’s Today programme, said that when he complained of pain and stiffness in his feet and fingers, he was ignored by his superiors and told to continue with his exercises.

It is thought that if the MoD admits liability for all the cases, it may have to pay out over £5 million in personal injury compensation.

A woman who fell outside a restaurant has been guaranteed a five-figure sum in compensation after a court ruled that the exit was unsafe.

Paula Jefferies, 46, had been for a meal at Gatley Tandoori in Stockport in December 2005, the Manchester Evening News reports.

As she left, she lost her footing on a concrete ramp and fell, breaking her ankle. Ms Jefferies went on to develop a potentially fatal blood clot because she was left immobile for several days.

She took legal action against the restaurant, claiming that the concrete ramp was uneven. This week, a judge at Manchester county court agreed that the ramp was "a trap for the unwary" and approved a compensation payout.

"I’m just very pleased and relieved that it’s over. It’s been quite stressful," Ms Jefferies told the newspaper.

The Health and Safety Executive (HSE) has issued a warning to care providers that they must ensure the safety of their patients.

Its warning comes after a man staying at the Northern General Hospital in Sheffield tried to open a window in May 2004.

Although the window was not supposed to open more than ten centimetres, it had not been properly maintained and swung open fully.

The 18-year-old fell 12 metres to the floor below, suffering a serious internal injury and several fractures.

Sheffield Teaching Hospitals NHS Foundation Trust was fined for breaches of the Health and Safety at Work Act 1974.

HSE inspector Kirsty Welsh said hospitals need to ensure that vulnerable people are not put at risk.

"The risk of falls from windows is well-known in the care sector. Hospitals have a responsibility to ensure they have preventative measures put in place," she added.

A teacher who claims she suffered post traumatic stress disorder after being repeatedly attacked by a pupil is seeking compensation from her former employer.

Teresa McCarthy, who worked at Drummond School in Inverness, was off work with stress and depression after the 13-year-old autistic boy punched her and pulled her hair over four attacks, the Press and Journal reports.

She is now suing Highland council for £250,000 in damages, alleging that she should have had better support from her line managers.

Giving evidence in court, psychologist Dr Peter Carr said: "If someone was attacked in an NHS hospital, no one would expect that person to go back to work and go back unprotected in the same situation. There would be enormous outcry about it."

A firefighter who was attacked by a gang of youths as he attempted to put out a house fire has received a compensation payout for the injury he received.

Peter Woodhead, 41, was one of five men who attended the blaze in Stockton last May.

However, as the team tackled the fire, their equipment was stolen by a nearby gang. When the firefighters tried to retrieve it, they were surrounded and set upon by the gang, some of whom had wooden fence posts.

Mr Woodhead suffered a broken elbow. He contacted the Fire Brigades’ Union (FBU) in order to seek compensation through the Criminal Injuries Compensation Association (CICA).

In a new development, he has now secured an undisclosed sum from the organisation.

Anyone pursuing a similar claim through the CICA should be aware that there is a two year deadline for making it, instead of the usual three year deadline for standard personal injury compensation claims.
