A British man who contracted the potentially fatal legionnaires’ disease has secured a compensation payout for the pain and suffering he was caused.
David Higgs, 47, went on a last-minute holiday to Tenerife with First Choice in September 2002, the Birmingham Mail reports.
However, two days into the break, he began vomiting and hallucinating, as well as suffering from diarrhoea and a fever, after using the Orlando Club Resort hotel’s shower.
He went to hospital in Tenerife, but was told he had gastric flu and was told to rest.
Upon the family’s return, Mr Higgs’s wife Jayne took him to hospital, where he was told that he had legionnaires’ disease and could have died within 12 hours if he had not been brought in.
After he recovered, Mr Higgs fought a long legal battle with First Choice, which has now admitted liability and agreed to a five-figure out of court settlement.
"It isn’t about the money, it is about making First Choice realise they cannot brush something like this under the carpet. This is a moral victory," said Mr Higgs.
Legionnaires’ disease is a potentially fatal form of pneumonia caused by bacteria that can be found naturally in environmental water sources such as rivers, lakes and reservoirs, usually in low numbers.

Compensation has been awarded to the family of a man who died after he was hit by a car.
Tony Gate, a highways worker, was struck by a vehicle being driven by 28-year-old Julie Verrall in 2003 as he put out roadworks signs, Hartlepool Today attests.
Although he survived the crash, he was left with serious brain damage and spent three years in a vegetative state in a nursing home before dying from pneumonia in 2006.
No criminal charges were brought against the driver, but Mr Gate’s family took legal action against her insurers.
They have now agreed to take some responsibility for the incident and have agreed on an undisclosed sum of compensation in an out of court settlement.
Linda Hughes, Mr Gate’s sister, said she was pleased with the new development.
"Tony was never able to tell us what happened on that day and now we feel the final piece of the puzzle has been found," she commented.
According to the Department for Transport, 2,943 people were killed on Britain’s roads in 2007.

The family of a man who died as a result of a hospital misdiagnosis are considering legal action, it has emerged.
Neville Caplan, 70, fell down some stairs while babysitting his grandchildren and fractured a vertebra.
He was taken to hospital, but was diagnosed with mild pneumonia, broken ribs and a sprained ankle.
Although he returned to hospital several times, four consultants and two radiologists at Wythenshawe Hospital and North Manchester General Hospital failed to spot his broken spine.
By the time he was correctly diagnosed three weeks later, it was too late to treat him and Mr Caplan died three days later.
Mr Caplan’s son Jeff, 51, said: "The coroner has identified a misdiagnosis in two of Manchester’s major hospitals. We are devastated by such an unnecessary death.
"It’s now in the hands of our lawyers. Compensation would be the next logical step."
Anyone who has endured pain and suffering as the result of a misdiagnosis, that would not have occurred had the diagnosis been correct, may be entitled to claim compensation and should seek legal advice.
