Sussex man injured on damaged road seeks compensation

A man who hit his head on the roof of his car after the vehicle went into a pothole is seeking compensation from the council he holds responsible.

Melvin Bangle, 71, had been driving in Bracklesham Bay when he hit the sudden dip in the road, the Surrey Herald reports.

The jolt was such that his jaw was clenched together, badly cutting his tongue and breaking several of his teeth.

Mr Bangle alleges that the council came out the day after his accident, which occurred in June, to fix the holes. He says he wants compensation for his ordeal, as well as the expense of his dental work.

"It’s not about the money, I want them to admit responsibility," the victim commented.

The AA said last month that there are as many as 1.5 million potholes on UK roads, putting motorists and cyclists at serious risk. President Edmund King said some of the surfaces are "crumbling".

Cyclist secures compensation after being injured in fall

A man who was riding his bike along a cycle path and fell off because of a dangerous drain is to be paid compensation for the injuries he sustained.

Iain Anderson, 42, was cycling through Holyrood Park in August 2005 when his bike hit a sunken drain at the end of a gully.

He was thrown off the bike and smashed his cheekbone, sprained his wrists and suffered cuts and bruises.

Witnesses attested that Mr Anderson had not been riding erratically and that the accident was due to the uneven cycle path.

He took legal action against Scottish ministers – because the path is owned by Historic Scotland – and has now been awarded £5,750.

A spokesperson for Historic Scotland said: "This was an unfortunate incident and we hope Mr Anderson is recovering well."

In April, it was reported that cyclist Ian Davis was to receive £7,600 in compensation after breaking his ribs and dislocating his shoulder when he was thrown over his handlebars because of a pothole in West Berkshire.

Pensioner in compensation battle over footpath fall

A woman is still battling for compensation months after a fall which left her with painful injuries.

Cynthia Saggers, 75, was walking along a footpath in Cambridge Park Road in Wanstead last autumn when she fell on a damaged, wobbly section, the Waltham Forest Guardian reports.

She broke both her arms, cut her face and injured her knees in the accident, which she says has left her in pain and unable to do everyday activities that she used to, such as playing bowls.

"The fall was so painful and my injuries were really bad," Ms Saggers commented.

Although an initial claim for compensation was rejected, she is continuing to pursue the allegations that Redbridge council should have repaired the footpath, since there were discrepancies regarding the size of the pothole in the council’s statement.

According to the BBC’s Inside Out programme, 20 councils paid out £1 million in damages between 2005 and 2007 as a result of injuries and damage allegedly caused by potholes.

Woman wins compensation from council after fall

A woman who fell in a pothole measuring seven feet long has been awarded compensation from the council following a legal battle.

Elaine Clements, 56, fell in the hole after stepping out of her car in New Malden in November 2007, local paper the Guardian reports.

She claims that the injury to her ankle left her in great pain for three months and that she was unable to carry out everyday activities such as yoga.

Although Kingston council initially denied that the footpath presented a serious hazard, a court ruled that it was 50 per cent responsible and Ms Clements will now receive a payout for the pain she was caused.

"What you want is a council that takes responsibility for its actions because it was a huge hole and it had been there for ages," she remarked.

Earlier this month, the Coventry Telegraph reported that 68-year-old Theresa Grafton is taking legal action against her local council after falling and breaking both of her wrists.

Woman injured in pothole fall to seek compensation

A woman who was hurt after falling into a pothole while out cycling is to seek compensation from the council she holds responsible.

Penny Edwards, who has previously competed in cycling competitions, was riding her bike into Norwich city centre when the front wheel got caught in an uneven part of the road, the Norwich Evening News reports.

She fell off the bike and suffered cuts and bruises to her face, as well as a chipped tooth.

"It was awful. It didn’t look like much but it really was nasty," Ms Edwards remarked.

She added that she plans to take legal action against Norfolk county council for failing to adequately maintain the road.

A spokesperson for the council said it uses a "common sense approach" when deciding whether or not to fix potholes.
