A man who suffered a head wound after being hit by a cherry picker outside a shop has been awarded a compensation payout.
Edwin Halsall, 63, was leaving a newsagent in Broomhill when the machinery swung around and hit him on the head, the Sheffield Telegraph reports.
He was left with severe cuts to his scalp and intense headaches.
“The picker was lowered into me, leaving me needing glue stitches in the gash on my head,” Mr Halsall commented.
He took legal action against John Comaish Advertising Services for negligence since the cherry picker was unsupervised.
The firm’s insurers have now admitted liability and agreed to an undisclosed payout as part of an out-of-court settlement.
Under health and safety regulations, contractors must put up danger signs for passers-by to avoid causing them injuries and must make sure that the machinery being used is out of range of people in the street.

The wife of a construction worker who suffered a brain injury after an accident on-site is seeking compensation from his employer on his behalf.
Christopher Kaye, 55, was working for Euro Dismantling Services in Sheffield last October when he was asked to remove a grapple attachment from a piece of machinery, the Sheffield Telegraph reports.
However, the grapple moved suddenly and hit him in the face, causing a severe brain injury.
Mr Kaye is now unable to communicate and has to be fed through a tube. He can move only his eyes and his right arm and leg.
His wife Susan is taking legal action against Euro Dismantling Services, claiming that the company was negligent and had not trained him in using the machinery.
A writ lodged at the high court also claims that the firm had not checked that the machinery was sufficiently stable before allowing the workforce to use it.
Euro Dismantling Services has declined to comment on the case.
According to the Health and Safety Executive, the rate of major injury in construction is the highest of any main industry group at 599.2 per 100,000 employees between 2007 and 2008.

Damages have been awarded to a man who worked as a hospital orderly after he was injured while disposing of clinical waste.
John Kitching from Barnsley had to have seven weeks off work following the incident in 2007, the Sheffield Telegraph attests.
He claimed that Barnsley Hospital had been warned by the trade union GMB before about the safety of the waste bins, which did not have brakes and moved when items were put into them.
"I decided to pursue compensation because I wanted the hospital to finally resolve this health and safety hazard, otherwise more people would be injured in the future," Mr Kitching remarked.
Barnsley Hospitals NHS Trust has now admitted liability and has agreed to an out-of-court settlement of £4,000 for the pain Mr Kitching was caused.
Figures from the Health and Safety Executive show that sickness absence among staff costs the NHS £1 billion a year.

A man who fell 14 feet off a ladder has secured compensation after he was forced to retire.
Jeffery Phillips, 59, had worked at Gunstones Bakery in Dronfield for 11 years when he was asked to clean the top of a divider machine in preparation for a customer visit in 2006, the Sheffield Telegraph reports.
However, the ladder he was using to reach the top of the machine slipped and Mr Phillips fell to the floor, breaking his hip, fracturing his elbow and hurting his hand.
He needed a hip replacement and was forced to give up work.
Mr Phillips took legal action against Gunstones Bakery, which admitted liability and agreed to an out-of-court settlement of £80,000.
"I decided to pursue compensation because I wanted the company to take full responsibility for the accident," the victim said.
He added that he had never received training in the use of ladders and would not want a similar fate to happen to anyone else for the same reason.
According to the Health and Safety Executive, ladders accounted for the greatest number of major injuries to employees due to both high falls (40 per cent) and low falls (28 per cent) in 2007-08.

A child has been awarded £8 million in compensation after she was left with cerebral palsy due to an injury in the womb.
The eight-year-old, who has not been named, was still in her mother’s womb when the car the pregnant woman was travelling in was involved in a head-on collision, according to reports in the Sheffield Telegraph.
Due to the force of the impact, a placental abruption occurred and the child was born with acute cerebral palsy, a non-progressive disorder that affects movement and communication.
She will need care for the rest of her life and her mother launched legal action against the other driver in order to be able to pay for this.
After the insurers of the other car admitted liability, a judge at the high court ordered a payout of £8 million.
According to Scope, one in 400 children born in the UK has cerebral palsy.
