Motorbike rider battles for compensation

A man who was seriously injured in a motorbike crash has appeared at the high court to argue his case for compensation.

David Buchan, 25, crashed into a car driven by Mark Whiting as he turned into a car park.

Mr Buchan hit the other vehicle at 30-45 miles per hour, hitting his head and suffering irreversible brain damage which has left him unable to live on his own, the St Albans & Harpenden Review reports.

He also needed cosmetic surgery for lacerations to his face and treatment for a fractured leg and spine.

Mr Buchan’s legal representatives argue that the accident was Mr Whiting’s fault, but he denies any liability for it.

In turn, his lawyers argue that Mr Buchan was the "author of his own misfortune" since he was travelling too fast before the crash.

The case is expected to conclude later this week.

According to the Royal Society for the Prevention of Accidents, while the number of motorbike deaths fell in 2007, the number of people seriously injured on motorbikes rose last year. The organisation recommended better training for people riding such vehicles.

Biker to sue company after mountain fall

A mountain bike rider who suffered serious injuries after being thrown from his bike is suing the company he claims is responsible.

Russell Pinder, 44, was riding in the Brecon Beacons in 2003 when the front wheel of his bike detached from the fork.

He was thrown over the handlebars and severely damaged his spine, resulting in paralysis from the chest down, Bike Radar reports.

Mr Pinder is now claiming damages from Fox Racing Shox, a California-based company that also makes products for snowmobiles, motorcross and all terrain vehicles, under the Consumer Protection Act 1987.

He claims a defect in the bike caused the wheel to detach and subsequently caused his injuries.

Neither Mr Pinder nor Fox Racing Shox were available to provide comment on the case.

For personal injury claims to succeed, the claimant must prove that the company or its employees were negligent and that the negligence caused his injury.

Care officer wins compensation following accident

A care officer has secured compensation following an accident in which she suffered a fracture to her right heel bone and a compression fracture to her spine.

The woman, who is employed by Walsall metropolitan borough council, was attending a charity event in the organisation’s car park when the incident occurred, Workplace Law Network reports.

She was using a trampoline when she lost her balance and attempted to step off the piece of equipment, landing heavily on the concrete ground beneath her.

In a recent development, the employee received £5,600 in a settlement with the local authority, which is headquartered in Walsall’s Civic Centre.

The council had denied liability, saying the employee involved was told to complete a risk assessment in relation to using the trampoline.

However, she denied ever receiving the instruction and claimed she was not present when the piece of equipment was set up in the car park.
