Here at Pryers solicitors in York we are pleased to detail another successful case. Our client had an anal fistula which was treated with insertion of a seton. There was then an unacceptable and substandard delay in further management and treatment, causing 18 months of PSLA (Pain, Suffering & Loss of Amenities). She finally received appropriate treatment which resolved the problem.
A medical negligence complaint was pursued to which we received an indifferent response. After obtaining the medical records and reviewing them, it seemed that the case looked very strong and causation was limited. The claim was valued at £5,000 – £10,000. A Letter of Claim was sent together with a Part 36 Offer for £15,000. We got a Letter of Response admitting liability with a counter offer for £10,000, which the client accepted today.

A man is seeking compensation following an accident which he says was caused by another road user.
Richard Tait, 62, had been riding his motorbike near Canning Town in October 2006 when he was hit by a car being driven by Olumuyiwa Ogunyode, the Essex Echo reports.
He badly hurt his shoulder, hip, groin and hamstring and fears he will never be able to work as an electrician again due to injuries limiting his movement.
Mr Tait claims that Mr Ogunyode was negligent because he pulled into a lane of traffic when it was unsafe to do so, did not indicate and did not check for vulnerable road users such as motorcyclists.
He has issued a High Court writ and it is thought that officials are now deciding how much compensation the victim should receive. Mr Tait is hoping to claim £250,000 for his lost earnings and suffering.
According to the Royal Society for the Prevention of Accidents, there were 493 motorcycle deaths on Britain’s roads in 2008.

A man who was left permanently disabled because a medical condition was left untreated is to receive compensation for his suffering.
Anthony Venner was admitted to Eastbourne District General Hospital in February 2005 with suspected compression of the nerves in his spinal cord, the Rye and Battle Observer reports.
Despite the condition, also known as cauda equina syndrome, being classed as an emergency, Mr Venner was not transferred to a hospital with MRI facilities until 20:30 GMT the following day.
The scan was then delayed until the day after. By the time the victim was diagnosed with cauda equina syndrome, he had already suffered permanent back damage, urinary and bowel difficulties and loss of sensation in his legs.
Mr Venner took legal action against the NHS trust responsible for both hospitals. Although they denied liability, a settlement of £72,500 has now been reached for the patient to cover his long-term care.
According to e-MedicineHealth.com, cauda equina syndrome is considered a surgical emergency and should be treated as soon as possible.

A number of diners are continuing to fight for compensation after they got food poisoning from a restaurant in Ilkley.
According to the Ilkley Gazette, as many as 60 people came down with the gastro-intestinal bug giardia lamblia after eating at the Saffron in 2007.
The owners were sentenced to community service in court this week for failing to run the restaurant in a safe manner and they have been banned from working with food for life.
However, the affected diners – who suffered from diarrhoea and weight loss – sought legal advice in order to get compensation for their suffering.
They are pursuing claims through the Saffron’s insurers, since the restaurant has now closed down.
Recorder Carl Gumsley said the eatery had been run in a "criminally inept" way and that it was "an accident waiting to happen".
Giardia lamblia is a single-celled organism that first came to light in the UK among those returning from abroad. It can be passed on in a number of ways, most commonly through contaminated water filters, BBC Health attests.

A man who thought he had had his appendix removed, only for it to burst a month later, is considering legal action against the hospital where he was treated.
Mark Wattson, 35, went into Great Western Hospital in Swindon on July 7th last year and was told his appendectomy was a complete success.
However, when he collapsed on August 7th, he was told that his appendix was still inside him and that it had ruptured.
After the second operation to remove it, Mr Watson developed an infection in the incision and had to remain in hospital for six days.
He also lost his job because his bosses did not believe that the first operation was real.
"Now I’m helpless. I can’t go out and find a job, I can’t go to interviews. I can barely walk and am in constant pain," the victim commented.
He is now thinking of taking legal action against Great Western Hospital for the suffering he was caused.
Anyone who suffers a physical or mental injury due to negligence during surgery could be entitled to make a surgery error compensation claim and should seek the advice of a solicitor.
