Payout for family who suffered burns on holiday

Compensation is to be paid to a family who sustained agonising burns after swimming in a hotel pool while on holiday.

Susan Austin and her partner Lee Sanders from Essex were among 33 Britons who suffered a reaction to chemicals in the pool at the Mitsis Roda Beach Hotel in Corfu, the Essex Echo reports.

They were left in so much pain that they could not put their clothes on over the broken skin. However, the hotel staff continued to put chemicals in the pool on a daily basis, even though many guests had already sustained burns.

After the holiday, 42 travellers took legal action against Thomas Cook for the pain they were caused.

They have now won their claim and are to receive an undisclosed sum in compensation from the tour operator.

Last month, the Daily Mail reported that £52,000 had been awarded to a child who suffered an electric shock in a hotel shower while on holiday in Kenya.

More than £2.5 million in compensation is to be paid to scores of holidaymakers who fell ill while at a resort in the Dominican Republic.

In what is being described as among the largest recorded payouts for such illness abroad, the 514 travellers who fell ill at the Bahia Principe Hotel in 2007 are all to receive compensation from Thomas Cook and its subsidiary MyTravel.

Their legal representatives argued that although many people had already been hospitalised as a result of dirty conditions which caused E coli and Salmonella, the tour companies continued to fly tourists to the resort between January and August the same year in "a flagrant disregard for their customers’ health and safety".

The tour operators decided to settle the claims outside of court, but assured customers that hygiene standards in its properties are constantly monitored.

Holidaymakers from the UK who suffer from an accident, personal injury or food poisoning while abroad can sue their tour operator provided that the holiday was a package which includes travel and accommodation.ADNFCR-1694-ID-19226916-ADNFCR

Couple to sue holiday firm after Cuban holiday nightmare

A Leeds couple is planning to sue travel firm Thomas Cook after a "nightmare" holiday in Cuba.

The Yorkshire Post reported that Amie Harvey and Kyle McGrory had been looking forward to a two-week holiday in the sunshine that they had booked with the travel firm, but things went wrong from the very beginning.

A fault with their plane meant their departure was delayed by one day – and when they arrived in Cuba, they found themselves caught in the middle of a category four hurricane.

To make matters worse, they contracted food poisoning, which they assert was caused by the reheated meals offered at the Playa Pesquero’s buffet.

Mr McGrory and Ms Harvey, suffering from severe stomach cramps, were flown home one week early and claim they still get ill from consuming spicy or rich food.

"The holiday was an absolute nightmare. The holiday reps were slow to react – it was a joke," said Mr McGrory.

The pair refused the £700 compensation offered by Thomas Cook and are now planning to sue the travel firm – claiming their gastric problems are a direct result of the food they were served at the Cuban hotel.

A Thomas Cook representative said the firm is undertaking a "full inquiry" into the incident, following the complaints of other travellers who have also claimed they suffered from food poisoning after eating at the Playa Pesquero.

Compensation claim launched by couple in ruined wedding

A claim for compensation has been launched against tour operator Thomas Cook after a wedding party was struck down with a gastric illness in the Caribbean.

Louise and Gareth Christie, both 28, were staying at the Jamaica Grande Resort in Ocho Rios, but fell ill shortly after their arrival.

The bride and best man were so ill that they had to be put on a drip and the couple’s children were also badly affected.

It is claimed that the hotel was poorly maintained and dirty and the Christies have now lodged a complaint against Thomas Cook in order to claim compensation.

"This was my dream wedding in tatters," said Louise Christie.

A Thomas Cook representative said: "We are currently undertaking a full investigation as a matter of priority and liaising with the solicitor representing the party."

Anyone struck down by illness on a package holiday may be able to claim compensation provided that the tour operator was at fault and the resort failed to exercise reasonable care to prevent infection.

Family of women killed abroad to sue tour company

A family is to seek compensation from a tour company after two sisters were killed in a holiday apartment.

Mildred Bowman, 67 and Alice Wardle, 62, died in August 2005 when a pull-down bed frame fell on top of them in Benidorm, the BBC attests.

Spanish authorities believe that the women suffocated from the pressure of the frame, but the resort was cleared of any wrongdoing.

Ms Bowman’s son Paul commented that he was disappointed with the recent verdict and that he will be pursuing the matter further with Thomas Cook.

"We are now going down the civil route. I don’t understand how it has taken three-and-a-half years to get to this outcome," he said.
