Medical negligence claim for unauthorised additional surgery

The Claimant underwent planned surgery for release of right trigger thumb but, whilst under anaesthetic, the surgeon also inadvertently performed right carpel tunnel release. The Claimant had never suffered with carpel tunnel syndrome and the procedure had never been discussed with the surgeon. The Claimant therefore had an additional scar which was numb, and associated weakness in his right hand for 4 weeks.
Liability was admitted at complaint stage, a Letter of Claim was served and a Part 36 offer of £6000 was made. The Defendant came back with an offer of £5000 and the Claimant accepted.

Woman suing former friend after mountain accident

A woman who was injured in a car crash in Morocco has issued a high court writ against her former friend who was driving the vehicle.

Gwynneth Moore, a passenger in the vehicle, is suing Maureen White for £300,000 in damages after she had to have part of her arm amputated following the accident in 2005, the Western Morning News reports.

Ms White was driving the Land Rover in the Atlas Mountains in Morocco when she overtook a coach and lost control of her vehicle. The car then hit the coach and both vehicles overturned, killing eight people onboard the coach.

Ms Moore has accused Ms White of negligence and is determined to seek compensation for her injuries, which also include carpal tunnel syndrome and post traumatic stress disorder.

Although Ms White’s insurers have admitted her liability, the two sides are unable to agree on the amount of damages that should be paid.

The Atlas Mountains stretch 2,400 km through Morocco, Algeria and Tunisia and are mainly comprised of dirt roads. Adventure Sports Holidays recommends hiring a mule rather than attempting to navigate the roads in a 4×4.ADNFCR-1694-ID-18730250-ADNFCR
