Motorcyclist awarded damages for underpass crash

A motorcyclist who was left severely injured after his bike crashed into a delivery van has been awarded compensation.

Bijan Fouladgar, 38, was heir to a sports business in May 2001 when he rode into an underpass in Blackfriars, the London Evening Standard reports.

However, he was unaware that a van had been performing a u-turn in the tunnel and Mr Fouladgar was unable to avoid it.

He crashed, suffering brain damage that left him "a shadow of his former self", the high court heard.

From being a successful businessman, he became vulnerable and unable to process information.

With the assistance of his family, Mr Fouladgar sued Southover Food Company – who were responsible for the van driver – and its insurers have now agreed to a £1 million payout.

"This has been eight years of my life tied up in this. Now I can finally try to get on with living my life," commented the victim.

According to the Department for Transport, motorcyclists are the most vulnerable group of road users in the UK.

Although they account for only one per cent of traffic, they make up 20 per cent of those killed or seriously injured in accidents.

Council backs down over compensation for damaged car

A council has made a u-turn after originally telling a man he would not be eligible for compensation when a lorry hit his car.

Mark Jones’s vehicle was parked outside his home in December last year when it was hit by a refuse collection lorry, the Staffordshire Sentinel reports.

The workers left a note on the car to say who had caused the damage, which included smashed lights and crumpled bodywork.

However, when Mr Jones sent in a £2,000 claim for damages, he was told that he would not receive compensation because the road was icy.

He contested the decision and has now been told that he will receive compensation after all.

"After a review, it appears regardless of the ice this accident may have happened anyway due to the density of cars and narrowness of the road, so we have made an offer without prejudice," said a Stoke council spokesperson.

Mr Jones said he is pleased with the new development, which has been described as a victory for common sense.

Anyone whose vehicle is damaged by a council vehicle should keep photographic evidence and any written correspondence in order to support their compensation claim.

BMA chair criticises “shoddy supermarket” NHS

The NHS is being run like a "shoddy supermarket war", a top doctors spokesman has claimed.

According to Dr Hamish Meldrum, the chairman of the British Medical Association (BMA), the government has performed a u-turn on its the commitment it made when it was first elected in 1997 to scrap the internal market in the NHS, reports the Daily Telegraph.

"Let’s stop diverting doctors’ energies into unholy bidding wars for jobs and contracts that they already do. Let’s follow the Celtic lead and get rid of the market in healthcare once and for all," he commented.

Dr Meldrum also criticised the government’s attempts to overhaul the way general practice is organised, saying that doctors and patients wanted to retain the current system.

The BMA is an independent trade union and voluntary association representing two-thirds of practising UK doctors.

James Fothergill, head of health policy at the Confederation of British Industry, accused the BMA of being misguided in its criticism.
