If you have been involved in any type of accident, our personal injury solicitors will use all their knowledge, skill and experience to secure the maximum amount of compensation that you are entitled to. Our personal injury solicitors are very experienced in winning personal injury compensation claims, and we will provide you with the professional advice you need, ensuring you are kept informed throughout your case. The first step is for us to discuss with you the circumstances of your accident, who or what caused it, details of the injuries you suffered and any financial losses you have incurred as a result of the accident. Once we have the necessary information we then write to the party responsible and their insurers to notify them of your case against them. At this stage we aim to establish that the other party was at fault for your accident. We will arrange an examination by an experienced medical expert on a date and time which is convenient for you. The expert will provide us with a report on the injury you have suffered and we can use the report to advise you on the likely value of your compensation claim.
Any other losses you have incurred as a result of the accident will have to be documented. You will need to keep receipts or invoices where possible and, for example, if you have been off work and lost earnings, we will ask your employer for confirmation of your loss.
When we have the medical evidence and you are happy with the content of the medical report and that we have correctly calculated all your losses, we send these documents to the other party's insurers asking them to put forward an offer to settle your claim. We will, of course, advise you as to how much compensation you are likely to receive and we will negotiate a settlement on your behalf, subject to your agreement. We will negotiate with the insurers on your behalf and extract settlement proposals.
If we cannot reach agreement with the insurers, because the offer of damages is too low or liability is disputed, we will issue court proceedings on your behalf so that a judge can decide the correct award. This does not mean that you will end up in court! Very few cases end up in a court room. Most cases settle out of court.
After judgement or settlement, we can expect to receive a cheque within about 4 weeks. If you are in receipt of state benefits, we can also advise you how to preserve your compensation payment and your benefits via a special form of trust.
